WHEREFORE, the Appellant - State most respectfully prays that this Hon'ble Court may be pleased to:- (a) GRANT LEAVE to appeal against the impugned Judgment and Order dated 09.01.2019 passed by the Hon'ble Court of VI Addl. District and Special Judge, Mysuru in S.C.No.365/2014 acquitting the Accused/Respondent for the offences punishable under Sections 366, 376 (2)(i) & (n) of I.P.C., Sections 5(1) r/w 6 of the POCSO Act, 2012 and also Sections 9 of the Prohibition of Child Marriage Act, 2006. (b) SET ASIDE the impugned Judgment and Order dated 09.01.2019 passed by the learned VI Addl. District and Special Judge, Mysuru in S.C.No.365/2014 (c) CONVICT AND SENTENCE the Respondent/Accused for the charged offences punishable under Sections 366 & 376(2)(i) & (n) of I.P.C. and Section 5(1) r/w Section 6 of the POCSO Act and also Section 9 of the Prohibition of Child Marriage Act in accordance with law, in the interest of justice.
To seek reversal of the trial court's acquittal and conviction of the accused for offences under IPC, POCSO Act, and Prohibition of Child Marriage Act.
Appeal by the State of Karnataka under Section 378(1) and (3) CrPC challenging the acquittal of the accused in a case involving alleged offences of kidnapping, rape, sexual assault of a minor, and child marriage.
