WHEREFORE, the Appellant-State prays that this Hon'ble Court be pleased to: a) GRANT Leave to Appeal against the judgment and order of acquittal dated 12.10.2022 in Special Case No.15/2016 passed by the learned Additional District and Sessions Judge - F.T.S.C - 1, Udupi (Special Court for trial of cases filed under POCSO Act), thereby, acquitting the Accused/Respondent of the offences punishable under Sections 376(2)(i) and 506 of IPC & under Section 6 of POCSO Act. b) SET ASIDE the judgment and order of acquittal dated 12.10.2022 in Special Case No.15/2016 passed by the learned Additional District and Sessions Judge - F.T.S.C - 1, Udupi (Special Court for trial of cases filed under POCSO Act), thereby, acquitting the Accused as Respondent of the offences punishable Under Sections 376(2)(i) and 506 of IPC c) SET ASIDE the conviction for the offence punishable under Section 11 and 12 of the POCSO, instead of Section 6 of the POCSO Act, 2012. AND: d) CONVICT AND SENTENCE the Respondent/Accused for the offences punishable under Sections 376(2)(i) and 506 of IPC and Section 6 of the POCSO Act, 2012 by allowing the appeal, in the interest of justice.
To seek reversal of acquittal and conviction of the accused for aggravated penetrative sexual assault and criminal intimidation of a minor under IPC and POCSO Act.
