WHEREFORE, it is most respectfully prayed that this Hon'ble Court be pleased to: (a) Call for records in Reference No.25/2022 dated 17.10.2023 passed by the Hon'ble Labour Court at Mysuru and Ex/236/2024 vide Annexure-A & B. (b) Issue a writ in the nature of Certiorari quashing the order passed by the Hon'ble Labour Court at Mysuru, in Reference No.25/2022 and Ex/236/2024 vide Annexure-A & B to the Writ Petition. (c) Grant such other order or direction as this Hon'ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity.
To invoke the High Court's extraordinary and supervisory jurisdiction under Articles 226 and 227 to quash the Labour Court's order and execution proceedings.
Challenge to the Labour Court's award directing reinstatement of daily wage hostel workers, with denial of back wages, on the ground that the hostel is not an 'industry' and the staff are not 'workmen' under the Industrial Disputes Act, 1947.
